DMCA Policy – NamiNest

Commitment to Copyright Protection

NamiNest is committed to protecting intellectual property rights and complying with the Digital Millennium Copyright Act (DMCA). In line with this law, we may:

  1. Remove or restrict access to material that we reasonably believe infringes another party’s copyright, and

  2. Suspend or terminate services for users who repeatedly violate copyright rules.

Your use of our website and services is always subject to our Terms of Service, which incorporate this Copyright Policy. Unless otherwise defined here, terms follow the definitions in the Terms of Service.

Filing a Copyright Complaint

If you believe that content hosted on or accessible through NamiNest infringes your copyright, please send a DMCA Takedown Notice to our Designated Agent with the following details:

  1. Authorized Signature: A physical or electronic signature of the copyright owner or authorized representative.

  2. Description of Work: Identification of the copyrighted work claimed to have been infringed.

  3. Infringing Material: Clear identification of the material alleged to be infringing, including enough information (such as URL or file path) for us to locate it.

  4. Good-Faith Belief Statement: A declaration that you genuinely believe the disputed use is not authorized by the copyright owner, its agent, or the law.

  5. Contact Information: Your full name, address, phone number, and email address (if available).

  6. Accuracy & Authority: A statement, made under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

What Happens After We Receive a Notice

Once we receive a complete DMCA Notice, NamiNest may:

  • Disable or remove the identified material from our site or services;

  • Notify the user who uploaded or provided the material that it has been removed; and

  • Enforce our repeat-infringer policy, which may result in suspension or termination of service.

Submitting a Counter-Notice

If you are the content provider and believe your material was removed by mistake or due to misidentification, you may submit a Counter-Notice including:

  1. Your physical or electronic signature.

  2. Identification of the removed or disabled content and its original location.

  3. A statement, under penalty of perjury, that you believe the material was removed in error or misidentified.

  4. Your name, address, phone number, and email address (if available).

  5. A declaration consenting to the jurisdiction of the appropriate U.S. federal district court for your address (or, if outside the U.S., any jurisdiction in which NamiNest operates) and agreeing to accept service of process from the original complaining party.

Restoration of Content

When a valid Counter-Notice is received, we may forward it to the original complainant. If the complainant does not file a legal action within 10–14 business days, NamiNest may restore access to the content at our discretion.
